Affordable Housing Scheme Application Process Privacy Notice
In order to administer the scheme, Clare County Council is required to collect and process certain types of information about applicants for the scheme. The information sought includes 'personal data' as defined by the Data Protection Acts and by the General Data Protection Regulations (GDPR)
Why do we have this privacy notice
Clare County Council, as the data controller, has created this privacy statement in order to demonstrate our firm commitment to privacy and transparency.

The legal basis
The legal basis for the processing of personal data in connection with affordable housing scheme application is:
- processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract in this case an "affordable dwelling purchase agreement" - article 6(1)(b) of the GDPR:
- processing is necessary for compliance with a legal obligation to which the controller is subject, namely the Affordable Housing Act 2021 and S.I. No 20/2023 – Affordable Housing Regulations 202 and S.I. No. 21/2023 – Affordable Housing (No.2) Regulations 2023. – article 6(1)(c) of the GDPR;processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, such official authority being provided by the Affordable Housing Act 2021 and S.I. No 20/2023 – Affordable Housing Regulations 202 and S.I. No. 21/2023 – Affordable Housing (No.2) Regulations 2023 – article 6(1) (e) of the GDPR.

Types of personal data
The type of personal data is identity data, ownership (of dwellings) data, residency data, marital status data, and income and financial data. The data involved are a statutory and contractual requirement under the application process for the scheme. The consequence of not providing the data would be to make your application incomplete or invalid.
How and the purpose your personal data will be used/processed
The personal data you provide with your application under the scheme will be processed for the purposes of administering the affordable housing scheme application process, and for no other purpose.
Where an affordable dwelling purchase arrangement is being entered into, minimal data (name and address) will be provided to the council's solicitor for administration reasons and name and contact phone numbers will be provided to the affordable scheme developer for communication purposes.
Recipients of the personal data
A limited team within the housing section of Clare County Council will have access to your data. A limited number of council IT section staff would also have access in connection with maintaining council systems. For the purposes of processing affordable dwelling purchase arrangements under the scheme, some of your personal data may be shared with the finance department in order to issue purchase documentation and in connection with audits.
Data provided by applicants for the scheme will be stored on a software platform “submit.com” hosted by a software company and the processes within the scheme will be managed within the platform. Your data may be accessed by a limited number of personnel in the software company in the connection with maintaining the software. A formal data processing agreement is in place with Submit Software Solutions Ltd.
Name and address details will be provided to the council’s solicitor; name and contact phone details will be provided to the developer of the scheme in cases where an application under the scheme results in an affordable dwelling purchase arrangement being put in place.

Clare County Council subscribes to the national policy for retention and destruction of local authority records.
Your data rights
You have the right to request access to personal data held about you, rights of rectification and erasure, rights of restriction and objection and rights of portability.
