Item 4: Notice of Motion No. 1 Proposed Developments at Abbey Street and Parnell Street Car Parks

To request clarification on any proposed developments at both Abbey St and Parnell St carparks with specific timelines being provided in terms of any planning application being considered and details of reports from all public consultations held twelve months ago.

 

Sean Lenihan, A/Director of Service, responded as follows:

Members will be aware that the proposed developments referenced above at Abbey Street and Parnell Street carparks are two of the projects included within the Ennis 2040 Economic & Spatial Strategy. Both have been identified as key opportunity sites critical to Ennis' future growth. 

Following extensive public consultation and engagement with key stakeholders, the Project team, consisting of E2040 personnel, Technical advisers and Council staff have carried out considerable work on both projects with a view to submitting for Planning approval to the appropriate Authority. 

This work is ongoing with an update briefing scheduled to be given to the Ennis Municipal District Members in early March followed by an update and workshop with the full Council scheduled for late March. Further details and invitations to same will issue in the coming week or so.

Cllr O’Callaghan stated that the response was disappointing as it effectively confirms that planning is being proposed yet does not provide any detail.  He cited the minutes from May 2023 which state that Members will be kept informed of all plans. He added that the traffic report which was promised has not been delivered. Cllr. O’Callaghan referred to the public backlash regarding the development of Abbey Street Car Park and posed the question as to who is advising on these plans and why are Members not kept informed.

 

Cllr Guilfoyle seconded the Motion stating that Cllr O’Callaghan posed a valid question.

 

Cllr Murphy supported Cllr O’Callaghan’s request for information particularly as there currently appears to be somewhat of a vacuum. He stressed the urgent need to fill the vacancy left by outgoing Cllr. Flynn, adding that there should be 3 Ennis Municipal District Members on the Board of Ennis 2040 DAC.

 

Cllr Daly supported the Motion and reiterated his long held view that Abbey Street Car Park and Parnell Street Car Park are crucial open spaces in the town. He added that Ennis2040 needs to take another look and find a new site.

 

Cllr Colleran Molloy agreed that it is imperative that Members are kept informed. She confirmed that it had been agreed at the February Council Meeting that Ennis Members will be briefed at a meeting on March 4th and that all County Members will be briefed at a workshop on March 24th.

 

Cllr O’Callaghan concluded cautioning that borrowings of €10m, and more to come, give real cause for concern and the end result must demonstrate value for money. He called for an independent review of Ennis2040.

 

 

Item 5: Notice of Motion No. 2  Green Bus / Dublin Coach

I am requesting Ennis MD invite in representatives from Dublin Coach into the chamber to address a growing number of issues relating to their service between Ennis and Dublin.

Cllr Howard briefed the Meeting on the difficulties faced by people who rely on this bus route to get to work or college. She outlined how in her opinion since the launch of the Ennis route in 2013 the standard has dropped steadily and in the last number of years has become unreliable and the app is not accurate. She stated given the importance of this route and the target of increasing the use of public transport, the providers of this service must be called to account.

 

Cllr Murphy seconded the Motion noting numerous occasions when the bus simply does not show up. Cllr O’Callaghan, in support, added that the service route is invaluable but there is currently a challenge in retaining bus drivers. Cllr Guilfoyle highlighted the frustration for users who pay in advance for a service that then fails to deliver. He cited this issue as an example of what typically transpires when a critical public service is handed over to the private sector.

 

Item 6: Notice of Motion No. 3 Space Finder App for Parking Availability

That the Ennis Municipal District launch a real time information app, such as the dlr Space Finder App which has been launched by a number of local authorities in Ireland, such as Dun Laoghaire and Killarney, which will provide real-time information on the location and live availability of the accessible parking spaces in Ennis. 

 

Paddy Tiernan, A/Senior Executive Engineer, responded as follows:

Ennis MD are happy to report that we expect such a project to be launched in the coming months. A successful funding application for a technological solution was previously made to the Department of Rural and Community Development under the Community Recognition Fund. Subsequently Ennis MD procured a supplier to install and maintain parking sensors within accessible spaces. This data will then provide real-time information via the ParkMagic App.

Cllr Colleran Molloy thanked Paddy Tiernan for the very positive response.

Cllr Murphy seconded the Motion recalling that during Covid lockdowns parking spaces were set aside for ‘click and collect’ adding these are no longer required.

Cllrs O’Callaghan, Guilfoyle & Daly supported the initiative.

Cllr Howard supported and added that this represents yet another piece in the accessibility jigsaw.

Paddy Tiernan in response to Cllr Murphy’s comment, clarified that the app is for disabled parking only, however, all parking will be examined further when the consultation takes place for the new Parking Byelaws for Ennis M.D.

 

 

Item 7: Notice of Motion No. 4 Grant Scheme for Power Generation Backup Systems for Elderly and Vulnerable Residents

Grant Scheme for Power Generation Backup Systems for Elderly and Vulnerable Residents

 

In light of the significant impact of Storm Eowyn, it has become increasingly critical to safeguard our most vulnerable citizens against the debilitating effects of power outages. Therefore, I propose the following motion:

 

The Ennis Municipal District calls on the Irish Government to urgently develop and implement an appropriate grant scheme. This scheme should be aimed at assisting elderly and vulnerable individuals in installing power generation backup systems in their primary residences, ensuring they maintain power during outages.

 

By facilitating access to backup power systems, we are taking necessary steps to protect and empower our community’s most at-risk members, ensuring their safety and well-being during future power loss events.

 

This initiative represents a vital progression in our commitment to being proactive in the face of climate challenges and protecting our community’s most vulnerable individuals.

Cllr Guilfoyle stated that the adoption of this Motion sends a clear message to the Department that this is a credible proposal towards enabling vulnerable citizens in the face of further power outages.

Cllr O’Callaghan supported the Motion and stated that whilst funding for such large scale proposals may be challenging, the potential even just to get grant aid to install a change-over switch would be an achievement.

Cllr Daly agreed that affordable generators, grant-aided by government, would give people the ability to be prepared for further major power outage.

Cllr Murphy agreed adding that there is an onus to protect those most vulnerable in our society.

Cllr Guilfoyle concluded thanking Members for their support and proposing that a letter to the Minister should issue from Ennis Municipal District as well as from Clare County Council.

 

 

Item 8: Notice of Motion No. 5 Public Lighting 6 no. Houses in Toonagh

I ask Ennis M.D. to consider installing public lighting on the main road, Ennis side, of Toonagh Stores, to accommodate approximately 6 no houses that are completely in darkness at nighttime presently.

 

Paddy Tiernan, A/Senior Executive Engineer, responded as follows:

Ennis Municipal District do not currently have a budget for new public lighting installations. We have checked with our colleagues in the Public Lighting Department who have advised they solely maintain responsibility for the maintenance of the existing public lighting network and do not possess a budget for new public lighting installations.

When assessing requests for public lighting and undertaking a cost-benefit analysis Ennis Municipal District must consider existing local conditions including the presence of footpaths, population density and the existing speed limit.

Given that the proposal is within a rural location, with an 80kph speed limit and has an absence of pedestrian facilities and a localised speed limit, it is deemed the installation of public lighting would not be appropriate at this current time. However, we will keep this project in mind should further funding opportunities present.

Cllr Daly acknowledged the response and requested that the relevant funding is sought.

Cllr O’Callaghan supported the Motion.

Cllr Murphy, whilst understanding the sentiment of the Motion, stated that it is unreasonable to expect public lighting for what in his opinion is unquestionably a rural setting, and stated account needs to be taken of wildlife protection in rural hinterlands. Some parts of Clarecastle’s outskirts do not have public lighting and these would be deemed more urban than Toonagh, he added.

Cllr Howard supported the Motion, suggesting a contribution later in the year from GMA 2025.

Cllr Daly concluded thanking Members for the support and he stated that Toonagh would be considered to be a village/hamlet and therefore public lighting was appropriate in this case.

 

Item 9: Notice of Motion No. 6 Pedestrian Footbridge New Road to Francis Street

I am requesting that Government funding be sought in order to facilitate provision of the proposed pedestrian footbridge from New Road to Francis Street. This proposal is an objective in our County Development Plan, it will help Ennis meet it's "10 minute town" objectives and will encourage greater usage of active travel and public transportation in order to move freely within the town centre.

 

Sean Lenihan, A/Director of Service, responded as follows:

Members will be aware that the provision of a pedestrian footbridge linking New Road to Francis Street remains an objective of Clare County Council and the provision for same has been included in the Clare County Development Plan 2023-2029.  Moreover, access to the River from the New Road side has been provided for as part of the recent CBS Primary School Planning Permission. 

 

Apropos the Motion, the funding for same remains the issue but we will continue to advocate for the project with the Active Travel Section of the NTA (National Transport Authority) while also seeking alternative means of funding at a local and national level for this item of strategic and critical infrastructure. Once available, it will have significant benefits in terms of encouraging active travel and modal shift leading to less car usage and the consequential traffic congestion in the town centre which would be very welcome indeed. 

 

I will keep the members informed accordingly of developments.

Cllr Murphy acknowledged and was happy with the response and reiterated that this is a critical piece of infrastructure which aligns with the “10 minute town” objective.

Cllr O’Callaghan supported the Motion and was delighted this initiative is provided for in the County Development Plan.

Cllr Howard supported the Motion in principle but considered that it would not be appropriate for the bridge to link directly to the primary school, that it would be more appropriate to link to the secondary school or elsewhere.

Cllr Daly supported the Motion and that such a footbridge would also be hugely valuable for users of Cusack Park.

Cllr Murphy thanked Members for their support.

 

 

Item 10: Notice of Motion No. 7 Review of Traffic Flow at Lower Market Street

To request a review of current traffic flow at lower market Street due to ongoing congestion. In addition consideration given to putting up signage highlighting the existing carpark.

 

Paddy Tiernan, A/Senior Executive Engineer, responded as follows:

The existing multi-storey car park within the Market area is in private ownership. Ennis MD would be supportive of any efforts by the owner of the property to erect appropriate signage to highlight the presence of this car park which in our opinion is significantly underused. We note that planning permission would be required for the erection of any additional signage. Ennis MD are willing to engage with the owner with a view to encouraging the progression of same.

Ennis MD also confirms that we will review traffic flow in the general Market Street area.

Cllr O’Callaghan highlighted the need to raise public awareness of existing parking facilities particularly for the underutilised multi-storey carpark. He suggested addressing the issue with the owners. He stated this car park, as well as the lower market street car park, may benefit from signage to attract better uptake.

Cllr Guilfoyle supported the Motion which and stated it aligns with the agreement to look at better usage of the market building and area in general and he agreed that signage was essential to highlight parking availability in town centres.

  

Item 11: Notice of Motion No. 8 New Ennis Bus Service – N85 Route

New Ennis Bus Service

It has been brought to my attention that the proposed route along the N85 /Lahinch Road to the Acha Bhile Housing Development is to be shelved. I am requesting that this route will be included in the new service.

 

Eamon O’Dea, Senior Executive Engineer, responded as follows:

The National Transport Authority have considered the demand and network characteristics of both route options, Shanaway Road and N85, and, whilst both have merit, the conclusion is that we should select the Shanaway Road option because:

  • There are more options to provide bus stop infrastructure close to residential areas, to help maximise coverage of the route;
  • Shanaway Road is of a character where it is more appropriate to install infrastructure for buses to turn around and wait in-between journeys; and
  • Selection of Shanaway Road will ensure that we can deliver required key infrastructure quickly so as not to delay launch.We also intend to include a set of bus stops close to the Shanaway Road/N85 junction, meaning that people from the residential areas along the N85 will have a bus stop as close to them as possible.Finally, as part of the ongoing Connecting Ireland Rural Mobility programme, we propose to enhance bus services along the N85 between Ennis and west Clare and to introduce new bus stops with infrastructure along the N85 close to Inisgrove/Acha Bhile. These new stops, coupled with the increase in services, will mean residents will also benefit from having a direct, accessible bus to Ennis town centre and railway station.This item was seconded by Cllr Guilfoyle and agreed by all Members. Cllr Guilfoyle seconded the Motion, and stated that having raised the issue regarding the omission of Barefield and it was clear that the Lahinch Road is a tributary road out of town and its omission could jeopardise the success of the new service. Eamon O’Dea, Senior Executive Engineer addressed the Meeting, clarifying that the bus stops chosen are those based on the economic decision of planners. He outlined that a number of factors come in to play, all of which are outlined in the response. He added that it should be remembered that the town side of Acha Bhile will have a bus stop, and also a stop at the back of Dunnes Stores. He further added that for those residents further out, the enhanced rural mobility bus routes will be the key service provider, rather than the new town bus service. He agreed to liaise again with NTA but cautioned that there are infrastructural limitations and that Shanaway Road was an obvious choice due to the extensive residential catchment, as well as the physical rotation ability for the bus. He outlined that the NTAs view is that this will provide the optimal bus route service. 

Cllr Howard suggested there is ample rotating space within Acha Bhile and she expressed huge disappointment on behalf of those residents, many of whom do not own a car, and for whom the new bus service was eagerly awaited.

Cllr Colleran Molloy commended the Motion, recalling that this issue would have been prolific during the election campaign and stated it was disappointing that the service was no longer planned to include Inisgrove/Acha Bhile.

Cllr O’Callaghan supported the Motion, and whilst acknowledging the selection of Shanaway Road, he argued priority equally needed to be given to the Lahinch Road if the new service is to deliver on reducing traffic congestion.

Cllr Howard acknowledged the response but expressed disappointment with the content of same. She stated she had been delighted that a bus stop for Acha Bhile had been in the original plan and further argued this estate is full of young family units who would hugely benefit from this service. She recalled that when Members met to discuss bus stops for the new service, Lahinch Road was deemed a critical stopping point.

Item 12: Notice of Motion No. 9 Ballyallia Lake Footpath Maintenance

That the Ennis Municipal District address the very poor condition of sections of the footpaths at Ballyallia Lake.

 

 

Paddy Tiernan, A/Senior Executive Engineer, responded as follows:

Ennis Municipal District confirms that we will carry out an assessment of all footpaths within the Ballyallia Lake area within the coming weeks. Where areas in need of repair are identified this will be carried out by Ennis MD crews. Should significant areas of footpath be in need of replacement a funding source will need to be identified.

Cllr Colleran Molloy thanked Paddy Tiernan for the response. She asked if it was possible to look at the cost of this proposal and she contrasted the huge spend on public realm works, when this category of work is essential and should merit due consideration.

Cllr Murphy seconded the Motion, recalling that former colleague Cllr Johnny Flynn had raised the issue that there were monies ringfenced for Ballyallia and it would be helpful if this could be clarified for Members.

 

Cllr O’Callaghan supported the Motion highlighting that the area was in obvious need of attention and he questioned if the more substantial scheme, which had been the subject of previous meetings, was being progressed.

 

Cllr Daly supported the Motion calling Ballyallia the ‘jewel in the Crown’ of Ennis. He stated that parking facilities are out of date and that many residents had looked to have the road-side boulders removed as they were unattractive.

 

Cllr Baker Bashua in support added that she too had received complaints on conditions in Ballyallia and she would strongly recommend funding is sought for this hugely important amenity.

 

Cllr Howard also supported the Motion, highlighting that the amenity was rediscovered by the community during the Covid lockdown and argued that this is a very valuable utility which warrants investment.

 

Cllr Colleran Molloy concluded that as the public lighting was provided all the way as far as Ballyallia, it would be great to now get some work done on the amenity itself.

 

Paddy Tiernan briefed Members, recalling a figure of circa €50k previously ringfenced for Ballyallia maintenance but that would need to be confirmed. He agreed that the large boulders were unsightly but had been put in place at the request of the residents due to fear of illegal encampment; however he would consider liaising again with residents with a view to removing them. These boulders, while offering some protection, are not the solution to illegal encampments, he said.

He stated with reference to the longer term plan for Ballyallia, that a lot of work has been done in last few years and the Ballyallia Lake Enhancement Scheme is progressing. He added that it is hoped to be in a position to go to Part 10 later in the year following the completion of a required underwater archaeological survey. He stated this survey was previously delayed due to weather conditions, and is now scheduled for March. He added that following this, the Part 10 Application will go to An Bord Pleanála. He also outlined how funding would then have to be provided and geared towards each of the segments of the scheme.

 

 

Item 13: Notice of Motion No. 10 Clareabbey Wastewater Treatment Plant – Complaints Register

Re CLAREABBEY WASTEWATER TREATMENT PLANT (since it's upgrading),

I am requesting that the Ennis Municipal Members are provided with all data collated

in relation to any reportings of poor odour/smells that have been reported by members of the public, or management of this recently upgraded facility. Also, how these reportings have been dealt with to date and how these are planned on being managed going forward.

 

Cyril Feeney, Senior Engineer, responded as follows:

The Environment section of Clare County Council have received 2 No. complaints (December 2023 and September 2024)  regarding possible odour issues at the Uisce Eireann WWTP at Clare Abbey.

The first complainant was advised to contact Uisce Eireann directly on 1800 278278. The second complaint which related to both water pollution and odour was investigated but no evidence of pollution or mal odour was detected on site.

It is not possible to determine the exact course of any future action until the exact nature of the complaint is known. However all complaints will be followed up on as required.

Cllr Murphy wished the record to note that more than 2 complaints have been made, he himself having lodged 2 and at least 1 other was made by Clarecastle Tidy Towns representatives. He expressed concern that complaints are not being registered. He added that the odour is unpleasant and warrants attention.

Cllr O’Callaghan seconded the Motion and vouched for having lodged complaints himself and stated the advice is that an upgrade has already been done but if the odour remains, a further investigation is warranted.

Cllr Guilfoyle commended the Motion adding that the complaints procedure is as much of a concern as the complaint itself and Irish Water need to be taken to account on this.

Cllr Murphy thanked Members for their support and suggested that this might be a matter for the EPA and he suggested a letter be issued to them.

 

Item 14: Notice of Motion No. 11 Gallows Hill (Kilrush Road side) Footpath Upgrade

I request Ennis M.D. to upgrade the main footpath on the Kilrush Road side of Gallows Hill (opp. Govt. buildings), as pedestrians and particularly people with disabilities regularly find it difficult to travel.

 

Paddy Tiernan, A/Senior Engineer, responded as follows:

Ennis MD carried out an assessment of this footpath within the last week. We would agree that an upgrade is required. Widening of the footpath is also warranted along part of the route.

We wish to make Members aware that this proposed project would require a significant level of funding. Unfortunately, this is currently not available. We will however seek to identify a funding source and will make an approach to the National Transport Authority regarding same.

Cllr Daly thanked Paddy Tiernan for the response and he would hope that the funding referenced can be sourced.

Item 15: Correspondence

Niamh O’Connor, Administrative Officer, read out an invitation from Mayor Kate Gallego, City of Phoenix, inviting the Mayor of Ennis to a twinning event from April 8th – 9th at the Phoenix Convention Centre.

  1. Cllr O’Callaghan congratulated Paddy Tiernan on his appointment as Acting Senior Engineer, and Donnagh Murphy as Acting Senior Executive Engineer. Cllr Colleran Molloy seconded this.
  2. Cllr Murphy recommended Ennis Members liaise on the invitation from the Mayor of Phoenix referenced under Item 6. correspondence.
  3. Cllr Murphy acknowledged his cousin, Bernárd Lynch, who had recently been honoured with the Freedom of the City of London. Cllr Murphy stated he was pleased that the Council had been preemptive in already having honoured Bernárd at a Civic Reception previously. Cllr Murphy outlined how Bernárd’s father turned 101 in January and suggested it might be appropriate for Ennis M.D. to acknowledge this by sending a birthday card. Mayor Clare Colleran Molloy read out the letter she received from Bernárd Lynch in response to her congratulatory note.  Cllr Pat Daly congratulated Bernárd Lynch as a highly successful Ennis native.
  4. Cllr Howard was joined by Members in issuing sympathy to the family of the late P.J. O’Driscoll R.I.P.
  5. Cllr. Murphy was joined by Members in issuing sympathy to the family of the late Paddy Hassett R.I.P, Moyriesk Quin. Cllr Murphy commented that Paddy had been held in great esteem and would be sorely missed.
  6. Cllr O’Callaghan acknowledged the team effort in the aftermath of the recent Storm Éowyn noting that the response had been greatly appreciated especially in Clarecastle. Cllr Murphy seconded this sentiment.
  7. In response to a request from Cllr Colleran Molloy, Paddy Tiernan updated Members on the latest traffic calming measures for Patrick Street Clarecastle. He outlined that an application had been made to NTA for funding, the outcome of which is imminent and the technical team are preparing drawings for a Section 38.
