Playgrounds privacy notice

Introduction

The purpose of this privacy notice is to describe, in clear terms, the personal data that will be processed as part of the administration by the Council of insurance provision for privately owned community playgrounds, which are subject to separate lease and playground agreements with the Council. This privacy notice explains why the personal data is needed, the legal basis, how it is used and how individuals may interact with the Council in relation their personal data. It also outlines the rights of individuals under data protection legislation.

1.0 Purpose of the processing data for these initatives

Community Playgrounds are supported by Clare County Council by providing insurance for the community playgrounds which meet the relevant requirements set out in the playground agreement between the Council and each playground committee.

Personal data is processed as part of the delivering insurance for relevant community playgrounds. The Council is obliged to protect such personal data in accordance with the Data Protection Act 2018 and the provisions contained in the General Data Protection Regulation (GDPR). The purpose of the processing of personal data is to:

  • enable communication between Clare County Council and the Playground Committee members in relation to safety inspection reports and safety monitoring.      
  • enable Clare County Council to contact committee members in the event of breach of the conditions in the playground agreement and the lease agreement with the Council;
  • enable Clare County Council to communicate queries/complaints from members of the public to the playground committee.
  • enable the administration of insurance claims.  

2.0 The Legal Basis for processing of personal data

The legal basis to process personal data is the following:

  • Article 6(1)( e) - the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Council.   The processing of the personal data is based on: the Local Government Act 2001 as amended, sections 65 and 66.
  • Article 9(2)(f), where special category data is concerned - the processing is necessary for the establishment, exercise or defence of legal claims or whenever courts are acting in their judicial capacity.


3.0 Categories of Personal data concerned

Personal data processed is:

  • Name, contact phone number, email address, postal address, health data could be in claims.

4.0 Recipients

Access to the data is generally limited to authorised personnel dealing with the administration of the insurance of community playgrounds within the Council.

IPB Insurance CLG would also be notified of insurance claim details, in the event of a claim being submitted to the Council. 
Third party access to personal data is not allowed except where it is provided for in law.

Access requests shall be processed in accordance with the Data Protection Act 2018, the GDPR and the Council’s data protection policies and procedures.

5.0 The retention period for the data

Correspondence and reports will be retained for minimum of 7 years after the granting of insurance. Claims ongoing are retained until the process is finished or a settlement reached, and then for a further 7 years.

6.0 Data subjects have a range of data rights

  • Right of access by the data subject
  • Right to rectification
  • Right to erasure (‘right to be forgotten’)
  • Right to restriction of processing
  • Right to data portability

7.0 Right of complaint with the supervisory authority

If you are not satisfied with a decision on your request for access to data or have concerns about personal data processing, you have the right to make a complaint to the Data Protection Commission,. 6 Pembroke Row, Dublin 2, D02 X963.   Before doing so it is recommended that you contact Clare County Council (DPA@clarecoco.ie) to establish the circumstances. We may be in a position to resolve the problem in a timely manner.
