How to make a submission

The Planning and Development Regulations 2001 to 2010 set out the procedures to be followed in respect of submissions/objections in relation to planning applications.

Submissions/objections must be made in writing within 5 weeks beginning on the date of receipt of the planning application. The five week period commences on the day that the planning application is received, such that the last day for receipt of an objection to an application received on 1st November is the 5th December. If the last day of this five week period falls on a Saturday, Sunday or public holiday, submissions/objections can be accepted on the next working day.

Submissions/observations received after the period of 5 weeks beginning on the date of receipt of the application shall be returned to the person concerned along with the fee and cannot be considered by the planning authority.

What to include in your submission/objection

All submissions/observations must be made in writing to the Planning Section, Clare County Council, New Road, Ennis and must include the following:

  • the name of the person or body making the submission/objection
  • the planning reference number of the application concerned
  • the address to which any correspondence relating to the application may be sent
  • a fee of €20 which can be payable by cheque, cash, credit card or bank transfer

In the case of a submission/observation with multiple signatories, an acknowledgement will be sent to one signatory only, the address of which should be indicated on the submission/observation.

If no fee is attached to the submission/observation it will not be considered and shall be returned as invalid.

Please note, in accordance with Article 35 (1) (d) of the Planning and Development Regulations 2006, persons who made a submission or observation on a planning application will only be notified of the receipt of further information or clarification of further information, where that further information or clarification of further information is considered significant and requires new public notices.

Withdrawal of an submission/objection

There is no mechanism in the regulations for the withdrawal of an objection. You may however, make a further addition to your submission instructing the planning authority to disregard your original observation. Please note that both the original submission and request for withdrawal of the submission will remain on the planning file but will not be considered by the Planning Authority when making a decision.
